Our firm filed a class and collective action lawsuit in Kentucky federal court under the Fair Labor Standards Act (“FLSA”) and Kentucky state law on behalf of servers, bartenders and other tipped employees who have worked at Carson’s. In this case, “tipped employees” are workers paid less than $7.25 per hour, plus customer tips. The lawsuit alleges, among other things, that Carson’s violated the tip credit provisions of the FLSA and Kentucky state law by requiring these tipped employees to share tips with employees who are not eligible to receive tips (like barbacks and bussers) and by requiring them to perform significant amounts of non-tip producing work (such as opening and closing “side work”). Some examples of non-tip-producing work are janitorial/cleaning and stocking work performed before the restaurants were opened to customers—when no customer tips could be earned—and similar work performed after employees were done serving customers. The lawsuit also alleges that these tipped employees were subject to an illegal mandatory tip pool.
