Our firm is investigating claims that Ford’s Garage has violated federal wage law with respect to how it paid its tipped employees. “Tipped employees” are workers paid less than the minimum wage (for example, less than $7.25 per hour in states where that is the minimum wage), plus customer tips, like servers and bartenders.

For example, we have reason to believe that tipped employees at Ford’s Garage were illegally required to share a portion of their customer tips with back-of-house employees who are not eligible to receive tips, like members of the dishwashing team.

We also believe Ford’s Garage violated federal law by improperly requiring its tipped employees to perform significant amounts of non-tip producing work (such as opening and closing “side work”), all while paying them less than the minimum wage. Some examples of non-tip-producing work are janitorial/cleaning and stocking work performed before the restaurants were opened to customers—when no customer tips could be earned—and similar work performed after employees were done serving customers.
