Misclassification of Managers
In many instances, employers improperly classify their employees in order to avoid paying them overtime.
For example, if you are paid a salary, but regularly worked over 40 hours per week with no overtime pay, your overtime rights may have been violated. Many “management” jobs do not meet the legal requirements to be exempt from overtime pay. Whether a salaried worker is entitled to overtime pay is not determined by his or her job title, but rather the job duties and responsibilities actually performed by the worker.
