Our law firm, along with the firm of Frank Freed Subit & Thomas, LLP, filed a collective action lawsuit in federal court under the Fair Labor Standards Act (“FLSA”) on behalf of all current and former non-exempt Sales Development Representatives of Payscale who worked in the U.S. at anytime since December 1, 2022. Under the FLSA, non-exempt employees are eligible for overtime pay at time-and-a-half (1.5x) their regular rate of pay for all hours worked over 40 hours in a workweek.
The lawsuit alleges that Payscale did not pay its non-exempt Sales Development Representatives proper overtime wages for all hours worked over 40 hours in a workweek. Rather, the lawsuit claims that Payscale took steps to limit the number of hours Sales Development Representatives recorded in Payscale’s pay and timekeeping system to avoid paying proper overtime wages to these employees.
