We currently represent servers who have worked for Tony’s Steaks & Seafood in a class and collective action lawsuit in federal court. The lawsuit covers servers who worked at any of the Tony’s Steaks & Seafood restaurants in Lexington and Bowling Green, Kentucky, Cincinnati, Ohio, and Indianapolis, Indiana.
The lawsuit seeks to recover wages owed to servers who are paid an hourly wage below the minimum wage, plus customer tips, and are required to share a portion of their customer tips with a service (or server) bartender who does not interact with customers. We allege that this tip sharing arrangement is unlawful under the federal Fair Labor Standards Act (FLSA) and applicable state laws.
