The lawsuit alleges that Trattoria Il Mulino violated the tip credit provisions of the Fair Labor Standards Act by requiring servers and bartenders to share tips with back-of-house workers who are not eligible to receive tips (like polishers), and by requiring them to perform significant amounts of non-tip producing work (such as opening and closing “side work” while being paid less than the minimum wage of $7.25 per hour), among other things. Some examples of non-tip-producing work are janitorial/cleaning and stocking work performed before the restaurants were opened to customers—when no customer tips could be earned—and similar work performed after employees were done serving customers.
